The pivotal antitrust trial concerning Meta‘s future has commenced this week, potentially reshaping the company’s landscape. At the center of this legal storm is Mark Zuckerberg, who has testified extensively as both sides lay out their cases. The US Federal Trade Commission (FTC) contends that Meta’s acquisition of Instagram and WhatsApp, alongside Facebook, creates a monopoly, stifling competition and harming consumers. The FTC argues that Meta’s dominance allows it to impose onerous advertising practices.

Meta counters by asserting that the trio of platforms categorized as “personal social communication services” are distinct entities that can coexist independently. Furthermore, Meta claims that increased advertising does not disadvantage users. Mark Zuckerberg even contemplated an exclusive ad stream, believing users view ads as potentially relevant content.

During the trial, Zuckerberg’s internal correspondence was presented, unveiling some of his unconventional ideas. Notably, Zuckerberg suggested that users delete their Facebook friends annually to rejuvenate the platform’s appeal. This radical idea, intended to reignite the excitement of reconnecting, was fortunately shelved.

Additional insights reveal that Zuckerberg had considered acquiring Snapchat and restructuring Instagram into a standalone entity, a notion abandoned before the FTC lawsuit materialized.

Prospects of an Out-of-Court Settlement

The trial between Meta and the FTC is predicted to span two months, but speculation abounds regarding a possible out-of-court settlement. Rumors suggest Meta may propose a substantial financial settlement to the FTC, initially offering $450 million, which reportedly increased to $1 billion. However, the FTC seeks a more substantial fine, potentially around $18 billion, coupled with an admission of fault from Meta.

Given Meta’s prominence in the US, there is a possibility of political influence, with Donald Trump purportedly favoring an out-of-court resolution. This stance might encourage the FTC to adopt a more conciliatory approach.
