The US Court of Appeals has ruled in favor of President Donald Trump’s decision to keep the California National Guard stationed in Los Angeles, marking a significant triumph for the administration. This move aligns with Trump’s strategy to employ military forces to address demonstrations opposing his immigration policies.
The Court of Appeals’ three-judge panel delivered a unanimous verdict, affirming that Trump acted within his legal rights to control the deployment of the National Guard.
Trump’s Reaction
In response to the ruling, Trump expressed his satisfaction on social media, labeling the outcome a “BIG VICTORY.” He emphasized that this decision sets a precedent for similar military deployments in other states whenever local authorities are deemed inadequate.
Did Trump Overstep His Legal Boundaries?
During the proceedings, the court examined whether Trump’s actions exceeded his legal authority. The state of California had initially sued the Trump administration, arguing the deployment was unlawful. A lower court sided with the governor, but the Trump administration challenged this verdict.
The administration contended that the protesters were hindering law enforcement activities, thus justifying the president’s decision to utilize the National Guard. However, the appeals court dismissed the notion that the president’s power to deploy the National Guard is beyond judicial scrutiny.
Thousands of Troops Deployed
In response to the unrest, Trump ordered approximately 4,100 National Guard members and Marines into Los Angeles. While acknowledging the occasional violence during protests, California officials maintained that state and local law enforcement were adequately handling the situation.
They also highlighted that no previous president has ever deployed a state’s National Guard against the governor’s wishes.
The outcome of this case is poised to be pivotal in determining Trump’s ability to enact similar measures in other states if protests persist. US District Judge Charles R. Breyer had earlier ruled in favor of the governor, asserting that Trump’s deployment exceeded legal boundaries and violated the US Constitution.
Judge Breyer had ordered that the control over the troops be transferred back to the governor. However, Trump appealed, and before this decision could be enforced, the 9th Court of Appeals allowed the troops to remain stationed in Los Angeles.
